Tougher workplace laws to have major impact in the Hunter

The NSW Government has launched a new Industrial Manslaughter Prosecutions Unit, a move expected to have a major impact on industries across the Upper Hunter and across the state.

The $6.9 million initiative, housed within the Office of the Director of Public Prosecutions, will investigate and prosecute cases where gross negligence leads to a worker’s death.

It marks the first time NSW has introduced a dedicated team to handle such cases, following the introduction of the state’s toughest workplace safety laws. Individuals can now face up to 25 years in jail, while corporations could be fined up to $20 million.

Previously, the maximum penalty under the Work Health and Safety Act 2011 was ten years’ imprisonment or an $11.1 million fine.

With its high concentration of mining, manufacturing and construction operations, the Hunter is likely to be among the regions most affected by the change.

The State Government say the new laws send a strong message that worker safety must remain the top priority, particularly in sectors where heavy machinery and industrial processes pose ongoing risks.

The Industrial Manslaughter Unit will be supported by senior and assistant solicitors, as well as a witness assistance officer, to help ensure thorough investigations and support for affected families.
